All Newcastle evening meetings will be held at the University of Northumbria, School of Law, City Campus East-1 at 6pm finishing at about 7.30pm. This talk will be held in the Harvard Lecture Theatre and details of room number will be confirmed in due course.
In this talk Jason will analyse the concept of vicarious liability both at common law and under statute, notably the Equality Act 2010, and in particular how two different approaches first converged but now appear to be diverging again. Building on the Wedderburn Memorial lecture given by Lord Justice Underhill at the ILS earlier this year Jason will also analyse the circumstances in which individuals can be held responsible for acts of unlawful discrimination and the strategies that could be used by both Claimants and Respondents to exploit vicarious liability and individual responsibility most effectively. He will argue that the employer’s statutory defence is too little raised, appears to be misunderstood and should be referred to more regularly by both Claimants and Respondents.
