The talk will cover developments in the law on the scope of an employer’s discretion to make decisions under the contract of employment following the recent judgment of the Supreme Court in Braganza v BP Shipping Ltd with the objective of considering the likely impact of that judgment in future cases. It will include consideration of the identification and categorisation of potential discretionary decisions; a study of Braganza – the analysis of contractual discretion and the outcome; matters relevant to the construction of contractual discretion and the special nature of an employment contract; rationality, reasonableness and standards of investigation; and conclusions on the impact of Braganza.
This meeting will be held in London. All London evening meetings are held at The Royal College of Surgeons, 35-43 Lincoln's Inn Fields, London, WC2A 3PE at 6.30pm, and will finish at about 8pm when wine and light refreshments will be served.
This meeting is free to members and open to non-members for a nominal fee (details below). Members do not have to pre-book their attendance at this meeting, unless they wish to do so.
